Terms of service
Last updated: 8 October 2026
1. Who we are
This website, crateengines.co.nz, is operated by Crate Engines Australia, trading as Crate Engines NZ ("we", "us", "our"). Engines are dispatched from our warehouse at 56 Export Drive, Molendinar, Gold Coast QLD 4214, Australia. You can reach us on +61 461 265 808, Monday to Friday, 8am to 5pm NZ time.
2. These terms
These terms apply to every order placed through this website. By placing an order you agree to them. Please read them before you buy, because an engine is a substantial purchase and the freight and customs arrangements are not the same as an ordinary online order.
We may update these terms from time to time. The version published on this page when you place your order is the version that applies to that order.
3. Orders
Your order is an offer to buy. A contract is formed when we send you an order confirmation. We may decline an order before that point, for example if the item is not in stock, if there has been a pricing or description error, or if we cannot verify the delivery address.
If we decline or cancel an order after you have paid, we refund you in full.
4. Prices, GST and what you pay on arrival
All prices on this website are in New Zealand dollars and exclude GST.
Every engine we sell is valued well above NZ$1,000. For goods of that value, New Zealand Customs collects GST at the border rather than the seller collecting it at checkout. We do not charge you New Zealand GST, and we are not able to.
You are the importer of record. When your engine arrives in New Zealand you are responsible for paying, directly to New Zealand Customs or your broker:
- 15% GST on the customs value, being the engine price plus freight and insurance
- the Import Entry Transaction Fee and Biosecurity System Entry Levy
- any customs broker fee for lodging the entry
Vehicle engines enter New Zealand duty-free, so no import duty applies. We will provide the commercial invoice and packing list your broker needs. Any figures we quote for these charges are estimates given in good faith; the amount Customs assesses is a matter between you and Customs, and we are not responsible for it.
We try to keep prices and specifications accurate. If an obvious error appears, we will contact you before processing the order and you may cancel for a full refund.
5. Payment
Payment is taken in full at checkout unless we have agreed otherwise in writing. We accept the payment methods shown at checkout. Title to the engine passes to you when we have received payment in full.
6. Freight and delivery
Freight is a flat rate set by your delivery region and is added at checkout. Delivery is typically 5 to 8 business days door to door, including sea freight and customs clearance. Those timeframes are estimates, not guarantees; sea freight, customs inspection and carrier schedules are outside our control.
Risk in the engine passes to you on delivery. Transit insurance is included on every consignment.
A crated engine is heavy palletised freight. You are responsible for ensuring the delivery address can accept it. If the address has no forklift or loading dock, tell us before you order so we can arrange a tail-lift truck. Where a delivery fails because the address could not receive the freight, a redelivery charge applies.
Please inspect the crate on delivery and note any visible damage before signing. Tell us within 48 hours of delivery if the engine arrives damaged, so we can act on the transit insurance.
7. Fitment is your responsibility, and we will help
Engines differ between model years, variants and build dates. You are responsible for confirming that the engine you order is correct for your vehicle.
We will confirm fitment with you at no charge before you buy if you give us your VIN or engine code, and we strongly recommend you do. A return costs far more than a phone call. Fitment guidance we give is advice based on the information you provide; it does not transfer responsibility to us for an engine ordered against incorrect vehicle details.
8. Installation
Engines must be installed by a suitably qualified mechanic, with new fluids, filters and ancillaries as required, and in accordance with normal trade practice. Damage caused by incorrect installation, contaminated fluids, overheating, pre-existing faults in the vehicle, or continued operation after a fault appears is not covered by our warranty.
9. Warranty
Every engine comes with a 1-year warranty covering manufacturing and assembly faults, as set out on our Warranty page. Extended cover is available. The warranty is in addition to, and does not replace, your rights under New Zealand consumer law.
10. Returns
Our change-of-mind policy, the costs that apply to it, and the process for returning an engine are set out in our Return and refund policy, which forms part of these terms.
11. Your rights under New Zealand consumer law
If you are a consumer, the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 give you guarantees and remedies that cannot be contracted out of. Nothing in these terms limits, excludes or modifies those rights. Where anything in these terms conflicts with them, those Acts prevail.
Where you acquire an engine for the purposes of a business, the Consumer Guarantees Act does not apply to that supply, to the extent permitted by section 43(2) of that Act. If you are buying for a business and would prefer the Act to apply, tell us before you order and we will discuss it with you.
12. Liability
Subject to clause 11, and to the maximum extent the law allows:
- our total liability in connection with any engine is limited to the price you paid for it;
- we are not liable for indirect or consequential loss, including loss of profit, loss of use of a vehicle, towing, vehicle hire, labour costs for removal or refitting, or loss of income.
Nothing in these terms limits our liability for fraud, or for anything that cannot lawfully be limited.
13. Stock and availability
Stock figures shown on this website are indicative and may not reflect real-time availability. If an engine you have ordered turns out to be unavailable, we will tell you promptly and you may wait for the next shipment or take a full refund.
14. Privacy
We handle your personal information in accordance with our Privacy policy.
15. Intellectual property
The content of this website, including text, images and product photography, belongs to us or our suppliers and may not be reproduced without permission.
16. Governing law
These terms are governed by New Zealand law, and the New Zealand courts have jurisdiction over any dispute. If you are a consumer in New Zealand, nothing in this clause deprives you of the protection of New Zealand consumer law.
17. Getting in touch
If something has gone wrong, please call us on +61 461 265 808 or use our contact page before anything else. Most problems are quicker to fix by phone than by email.
